Toronto police say the parents arrested in the death of a four-year-old North York boy have been charged with first-degree murder.

On Monday, paramedics were called to a townhouse complex in the Finch Avenue and Don Mills Road area where they found the child not breathing and were unable to resuscitate him.

Joel Roberto, 27, and Ravyn Colley, 24, both of Toronto, were each initially charged with failing to provide the necessaries of life but that offence was upgraded to first-degree murder on Thursday.

The parents, who made a court appearance at Old City Hall on Thursday, are scheduled to appear in court on Oct. 24 in North York. They will remain in police custody. There is a publication ban at the defence’s request on any evidence heard at a bail hearing.

The boy was the city’s 46th homicide victim of the year.
